TERMS OF SERVICE

LSprogramming offers programming of light and siren control files using the Whelen Command software which is provided by Whelen Engineering Company, Inc., 51 Winthrop Road, Chester, CT 06412. LSprogramming is not affiliated with and does not work for Whelen Engineering Company, Inc.

 

The term “file” used in the terms of service refers to the Whelen Command file itself as well as all the functions controlled through this file which includes but is not limited to controls, flash patterns and sirens.

By accepting a quote from LSprogramming and hiring LSprogramming to program a customers Whelen Command file, the customer accepts to the following:

The use of files provided by LSprogramming is at own risk.

LSprogramming is not responsible to know the light and siren laws and regulations that apply to the customers vehicle. It is the customers duty to inform LSprogramming about any applicable light and siren laws and regulations. If a file provided by LSprogramming features any function that does not comply with applicable laws and regulations, the file is not to be used. The customer is required to check and make sure that the file complies with laws and regulations that apply to the customers vehicle. LSprogramming assumes no liability for the compliance of a file with any laws and regulations.

LSprogramming is no vehicle upfitter and cannot provide in-person services. LSprogramming cannot supervise a customers file transfer to the customers programmable Whelen system in the vehicle. LSprogramming assumes no liability for any errors and malfunctions caused by the file. LSprogramming is not liable for any software and hardware errors and malfunctions caused by the file transfer to the customers programmable Whelen system. Furthermore LSprogramming is not liable for any damages to the vehicle or the installed lights, sirens and other products. LSprogramming assumes no liablity for any costs caused by errors and malfunctions.

Before using a file provided by LSprogramming on the customers vehicle/s, the customer is required to thoroughly check the file with caution on non-public places for any errors. The light and siren control file shall only be used on public roads after the customer made sure it is free of any errors and after making sure it complies with applicable laws and regulations. The use of files provided by LSprogramming is at own risk.

The customer is required to confirm to LSprogramming that extensive testing of the file has been done and that the file is free of any errors before placing a vehicle with the file into service. LSprogramming is not liable for any accidents caused while using the file or while using the lights, sirens or any other function controlled through the file.
